Texas and Mississippi AGs Say Clerks Don't Have to Follow Marriage Ruling The Attorneys General of Texas and Mississippi declared this weekend that clerks in their states do not have to issue marriage licenses to gay applicants. In Mississippi, Attorney General Jim Hood declared the ruling would not be observed until the Fifth Circuit Court of Appeals decided a case about Mississippi's ban. In Texas, the state AG promised legal help to defend any county, clerk, judge, or justice of the peace who refused to issue a license based on their religious beliefs.
